Litigation

The dispute resolution team at Carcelén, Desmadryl, Guzmán, & Tapia offers a high degree of specialization in complex litigation and arbitration, which generally require to relate with experts from different specialties, and which have a significant component of regulatory law. Hence, their practice is a perfect and continuous complement for every other area of the firm, allowing us to offer a comprehensive and strategic perspective of the legal matters entrusted to us.

Our lawyers on the team have experience in dispute resolution related to different industries, on environmental law; sanctioning and contentious administrative processes; constitutional remedies; disputes regarding the fulfilment of supply agreements; conflicts related to the construction of power plants and infrastructure works; and in trials over non-contractual liability.

Some of our lawyers also have experience in arbitration hearings under the Arbitration Rules of the United Nations Commission on International Trade Law (UNCITRAL); and under the rules of the International Chamber of Commerce (ICC) in conflicts relating to the construction of large-scale engineering works.

Besides representation in court proceedings, Carcelén, Desmadryl, Guzmán, & Tapia renders counseling in strategic analysis of contracts to detect contingencies and prevent conflicts. Due to the high levels of specialization of our firm, several of our lawyers are required to issue legal opinions to be presented in litigation and arbitration of different nature.

Our dispute resolution department comprises three lawyers and is led by partner Eduardo Ugarte, who has been acknowledged by Chambers Partners, Legal 500, Leader Leagues and Best Lawyers as an outstanding attorney in the areas of civil and commercial litigation and arbitration.
